OPINION- CÓDIGO PENAL, CONTRATACIÓN LABORAL, INICIATIVA PRIVADA EN CUBA.

.. La Constitución cubana sólo garantiza los derechos a los ciudadanos si es en la construcción del socialismo y del comunismo. O sea, no hay ningún derecho que el ciudadano tenga que no sea subordinado a eso y esa es una cuestión subjetiva.
El Código Penal tiene decenas de delitos contra la seguridad del Estado, habilitando el fusilamiento, la pena capital, para muchísimas de estas cosas. Tiene la aberración jurídica que llaman “peligrosidad pre-delictiva”, por la cual se calcula que hay miles de personas sirviendo prisión por este supuesto delito. Es un delito para Cuba pero una aberración para cualquier otro país.
Si la persona da la impresión, si las autoridades determinan que esta persona tiene una propensión a atentar contra la moralidad socialista o contra el orden , se le mete en prisión. Eso está en el Código Penal cubano. Entre otras cosas, hay artículos que prohíben la salida y la entrada al país de los ciudadanos sin autorización del gobierno, en amplia violación de principios fundamentales del derecho incorporados en la Declaración Universal de Derechos Humanos.
.. Cuba ha estado abierta al mundo, es decir, a la inversión en turismo de países capitalistas occidentales desde el año 93 oficialmente, si no antes. Con la caída del subsidio soviético, Cuba se vio forzada a abrir al capitalismo a ciertos sectores; aunque son enclaves y en sociedad con el gobierno. Hay más de 20 años de experiencia: las empresas que han entrado a Cuba, incluyendo las de este país, no han exigido condiciones de empoderamiento a los ciudadanos, empezando con cosas tan básicas como contratar a sus empleados directamente sin tener que hacerlo en una entidad del Estado y pagándole al Estado que confisca el 95 por ciento del salario.
Un empresario que abre un hotel en Cuba no puede contratar directamente el personal?
.. Ningún empresario ni diplomático. Todas las misiones diplomáticas, todo extranjero que haga negocio en Cuba tiene que contratar empresas del Estado cubano que le dicen usted debe escoger entre estas personas, que por supuesto son seleccionadas. Y hay un Código Laboral especial para trabajadores que están en el sector externo. Así es Cuba. Y afuera no entienden eso. (En el exterior) no entienden esto. Muchos culpan al embargo de los Estados Unidos, pero desde el año 2000, Estados Unidos ha hecho muchas excepciones a las sanciones económicas y le puede vender productos agrícolas a Cuba. Y también la Argentina puede venderle productos agrícolas, Francia, Italia, etcétera. Sin embargo, desde Cuba, hay una sola empresa que compra productos, maquinarias, etcétera, que se llama Alimport. Ningún cubano puede comprar a ningún argentino o estadounidense.
En la iniciativa individual: Se ha avanzado en Cuba?…
En años recientes, porque el Estado estaba tan mal económicamente, quiso dejar parte de la fuerza laboral dentro de este nuevo sector que algunos llaman privado pero en realidad es un sector, digamos, no atado al Estado, no directamente por lo menos, que es el auto empleo, porque en Cuba no existe la propiedad privada y tampoco se le permite a cualquiera que tenga un negocio propio, que tenga propiedad jurídica. Pero se aprobaron aproximadamente 200 categorías de oficios que pueden ser practicados independientemente, peluquero, ese tipo de cosas, como ha dicho un colega, oficios casi medievales. Pero además se permite tener un restaurante dentro de la casa…
Hay ciertos negocios como los bicitaxis, taxis privados, sectores fuertemente regulado, hay que tener licencia. Muchos crecieron por un tiempo y muchos han cerrado, han llegado a su tope, porque no hay posibilidades de crear capital como en cualquier país capitalista. Ahora mismo por ejemplo hay un problema muy grande con los taxistas, que les llaman boteros, bicitaxis, porque el gobierno quiere imponer un control de precios que significa que cobrarían menos de lo que les cuesta dar el servicio.

.. The Cuban Constitution only guarantees the rights to citizens if it is in the construction of socialism and communism. it means that the citizen has any right but to be subordinated to that and that is a question subjective.
The criminal code has dozens of crimes against the security of the State, enabling the execution, the death penalty, for many of these things.
