CUBAN GOVERNMENT FIXED ‘QUOTA’ OF FOREIGNERS ALLOWED TO WORK IN THE MARIEL ZONE.

The Ministry of labour and Social Security set «quota» recruitment of foreign staff for dealers and users of the special zone development Mariel. Non-resident aliens may cover up to 15 percent of the total workforce in the ZED-Mariel.
The measure is contained in resolution No. 21/2016 of the Ministry of labour and Social Security (MTSS), published on December 8 in the Official Gazette No. 40 extraordinary (version digital:www.gacetaoficial.cu) dealers and users established in the special zone development Mariel (ZEDM) may contract directly to foreign natural persons not resident in Cuba up to a limit not exceeding fifteen per cent of the total number of employees.
(But)… At the request of the Office of the ZEDM, the MTSS may exceptionally approve rates above 15 per cent for specific and substantiated, meets with the rules.
Setup – explained in the legal text – was adopted given the need to set the limit of foreign natural persons not resident in Cuba that can be hired directly by dealers and users to work in the ZEDM business.
It also responds to established by Decree Law No. 313 of 19 September 2013, the special zone development Mariel, that empowers heads of organs, organisms of the Central Administration of the State and entities that apply, to issue – within the framework of its competence – the legal provisions necessary for the application of the rule.
According to Decree Law No. 313 (DL-313), «dealers and users can contract directly to foreign natural persons not resident in Cuba to perform management positions or certain jobs of a technical nature, prior approval of the competent authority”.
Also States that these “people can stay and work in the country, fulfilling the immigration, tax and labor regulations”.
The labour special regime granted to the ZEDM through the DL-313 sets than the “workers who work in the area should be, as a rule, permanent residents in Cuba, whether Cuban or foreign».
Is ordered, in addition, that the «procurement of the Cuban or foreign workers, permanent residents in Cuba, who provide their services to dealers and users in the area, is carried out by the Cuban entity designated for this purpose under the contract that is signed for this purpose».

GOBIERNO CUBANO FIJA ‘CUOTA’ DE EXTRANJEROS PERMITIDOS TRABAJAR EN LA ZONA DEL MARIEL.
El Ministerio de Trabajo y Seguridad Social fija «cuota» de contratación de personal foráneo para concesionarios y usuarios de la Zona Especial de Desarrollo Mariel. Extranjeros no residentes podrán cubrir hasta el 15 por ciento del total de trabajadores en la ZED-Mariel.

La medida está contenida en la resolución No. 21/2016 del Ministerio de Trabajo y Seguridad Social (MTSS), publicada este 8 de diciembre en la Gaceta Oficial No. 40 Extraordinaria (versión digital:www.gacetaoficial.cu) Los concesionarios y usuarios establecidos en la Zona Especial de Desarrollo Mariel (ZEDM) podrán contratar directamente a personas naturales extranjeras no residentes en Cuba hasta un límite que no exceda del quince por ciento del total de sus trabajadores.
(Pero).. A solicitud de la Oficina de la ZEDM, el MTSS podrá excepcionalmente aprobar porcentajes superiores al 15 por ciento para casos puntuales y justificados, resuelve la normativa.
La disposición —se explica en el texto legal— fue adoptada ante la necesidad de establecer el límite de personas naturales extranjeras no residentes en Cuba que pueden contratarse directamente por los concesionarios y usuarios para laborar en los negocios en la ZEDM.
También responde a lo establecido por el Decreto Ley No. 313 de 19 de septiembre de 2013, De la Zona Especial de Desarrollo Mariel, que faculta a jefes de órganos, organismos de la Administración Central del Estado y entidades que correspondan, para dictar —en el marco de su competencia— las disposiciones legales necesarias para la aplicación de la norma.
Según el Decreto Ley No. 313 (DL-313), «los concesionarios y usuarios pueden contratar directamente a personas naturales extranjeras no residentes en Cuba para desempeñar cargos de dirección o determinados puestos de trabajo de carácter técnico, previa aprobación de la autoridad competente».
También establece que estas «personas pueden permanecer y trabajar en el país, cumpliendo las disposiciones migratorias, fiscales y laborales vigentes».
El Régimen especial laboral que se otorga a la ZEDM a través del DL-313 fija que los «trabajadores que laboren en la Zona deben ser, como regla general, residentes permanentes en Cuba, ya sean cubanos o extranjeros».
Se ordena, además, que la «contratación de los trabajadores cubanos o extranjeros, residentes permanentes en Cuba, que presten sus servicios a los concesionarios y usuarios de la Zona, se efectúa por la entidad cubana designada a estos efectos, en virtud del contrato que para ello se suscriba».
