The Customs of Cuba has modified the provisions related to the process of customs clearance of foreign recreational vessels in authorized marinas. Thus, from this Sunday, January 1, it will only authorize foreign yachtsmen to temporarily import motor vehicles that arrive aboard their own ships.
This is reflected in Resolution 336/2017, which modifies its articles 79 and 80 on customs control rules for ships and aircraft. In this way, the person who arrives in Cuba on a recreational boat must go to the Customs Office to do the customs clearance, using a new model, which requires them to declare sums of more than $ 5,000.
Also clarifies that foreign vessels that go to Cuba can only be used for tourism purposes, so that the yatists should refrain from any commercial activity not authorized by the Cuban authorities.
The yatistas can only import their personal effects provided that the quantities, articles and values correspond to what the law indicates.
It must be remembered that on January 1 the immigration reform announced by Foreign Minister Bruno Rodríguez, which allows the return to Cuba on recreational boats to Cubans residing in the United States, takes effect. They may do so through Marina Hemingway and Gaviota Varadero, although the latter has been vetoed by the Trump Administration, which considers that the money of US citizens who use its facilities may benefit military institutions, intelligence forces or the Cuban State Security.

For the purpose of making the necessary adjustments in the provisions related to the process of dispatch of foreign recreational vessels in the Marinas enabled for international maritime traffic and with the objective of facilitating and expediting the customs clearance of these vessels and of the yachtsmen who Arrive aboard them, the Chief of the General Customs of the Republic issued Resolution 336-2017, which will come into force on January 1, 2018.
The Norm:

ADUANA CUBANA MODIFICA LA IMPORTACIÓN A CUBA PERMITIENDO LLLEVAR SUS VEHICULOS EN LOS BARCOS DE RECREO.
La Aduana de Cuba ha modificado las disposiciones vinculadas al proceso de despacho aduanero de las embarcaciones de recreo extranjeras en las marinas habilitadas. De esta forma, a partir de este domingo 1 de enero autorizará sólo a los yatistas extranjeros la importación temporal de vehículos automotor que arriben a bordo de sus propios barcos.
Así lo recoge la Resolución 336/2017, que modifica sus artículos 79 y 80 sobre normas de control aduanero de buques y aeronaves. De esta forma, la persona que arribe a Cuba en una embarcación de recreo deberá presentarse en la Oficina de Aduanas para hacer el despacho aduanero, utilizando un nuevo modelo, que obliga a declarar sumas de dinero superiores a los 5.000 dólares.
Asimismo aclara que las embarcaciones extranjeras que vayan a Cuba sólo podrán utilizarse con fines turísticos, por lo que los yatistas deben abstenerse de hacer cualquier actividad mercantil no autorizada por las autoridades cubanas.
Los yatistas sólo podrán importar sus efectos personales a condición de que las cantidades, artículos y valores se correspondan con lo que marca la ley.
Hay que recordar que este 1 de enero entra en vigor la reforma migratoria anunciada por el canciller Bruno Rodríguez, que permite el regreso a Cuba en embarcaciones de recreo a cubanos residentes en Estados Unidos. Podrán hacerlo por la Marina Hemingway y Gaviota Varadero, aunque esta última ha sido vetada por la Administración Trump, que considera que el dinero de los ciudadanos norteamericanos que utilicen sus instalaciones puede beneficiar a instituciones militares, fuerzas de inteligencia o a la Seguridad del Estado cubana.

A los efectos de realizar las adecuaciones necesarias en las disposiciones vinculadas al proceso de despacho de las embarcaciones de recreo extranjeras en las Marinas habilitadas para el tráfico marítimo internacional y con el objetivo de facilitar y agilizar el despacho aduanero de estas embarcaciones y de los yatistas que arriban a bordo de ellas, el Jefe de la Aduana General de la República emitió la Resolución 336-2017, la cual entrará en vigor el 1ro de enero de 2018.
La referida Norma:
Modifica los artículos 79 y 80 de la Resolución No. 187 “Normas para el despacho y el control aduanero de buques y aeronaves”, del Jefe de la Aduana General de la República y se establece el término en el cual el yatista que interese desembarcar debe preentarse ante la Oficina de Aduanas para realizar el despacho aduanero, así como que las embarcaciones de recreo extranjeras que arriben a la República de Cuba sólo pueden ser utilizadas para realizar operaciones con fines turísticos y que los yatistas a bordo de ellas se abstendrán de efectuar cualquier otra actividad mercantil no autorizada por las autoridades cubanas competentes
Establece que los yatistas sólo pueden importar sus efectos personales, a condición que las cantidades, artículos y valores se correspondan con lo establecido en la legislación vigente.
