Havana Club rum is at stake in the courts and it is still unclear who really owns the property. This is disputed and it also seems that the protection of the trademark has expired giving way to its use, although this decision is being appealed.
The great-grandfather of the current patriarch, Ramón Arechavala, was the original founder of the recipe and the brand, there by 1935. With the Cuban revolution, the family was forced to abandon their facilities, they left the country and Castro dismantled the business and emptied the brand.
In 1993, the Fidel regime signed an agreement with the French company, Pernod Ricard, for the production and distribution of rum under the original brand, Havana Club. At that time, the family wanted to protect their interests and, since they did not have the necessary money, they sold the recipe and the brand to Bacardi, who had suffered from the same Castro regime.
At that time, the commercial and legal battle between the two beverage multinationals, Bacardi and Pernod Ricart, began to establish itself as the sole suppliers of the original Havana Club rum.
Cuba says that only they can sell the real Cuban rum, which must be manufactured in Cuba (although, because of the embargo, it can not be exported to the United States) and the family says that only they have the original Havana Club recipe and the expropriation Cuban does not grant rights to that country and, even if they manufacture it in Puerto Rico, it remains original Cuban rum.
Considering how all this has developed up to now, the expropriations, the politics, and the lack of rum appellation, who really is right and who really is the owner of Havana Club?
Time will give us the answer of those who are the true owners.
QUIEN REALMENTE ES EL PROPIETARIO DE LA MARCA DEL RON HAVANA CLUB?
El ron Havana Club está en juego en los juzgados y todavía no está claro quién realmente tiene la propiedad. Esta se disputa y también parece que la protección sobre la marca ha caducado dando vía libre a su uso, aunque esta decisión está siendo recurrida.
El bisabuelo del actual patriarca, Ramón Arechavala, fue el fundador original de la receta y de la marca, allí por 1935. Con la revolución cubana, la familia fue forzada a abandonar sus instalaciones, se fueron del país y Castro desmanteló el negocio y vació la marca.
En 1993, el régimen de Fidel firmó un acuerdo con la empresa francesa, Pernod Ricard, para la producción y distribución del ron bajo la marca original, Havana Club. En ese momento, la familia quiso proteger sus intereses y, como no tenían el dinero necesario, vendieron la receta y la marca a Bacardi, que había sufrido expolio del mismo régimen castrista.
En ese momento se inició la batalla comercial y legal entre las dos multinacionales de bebidas, Bacardi y Pernod Ricart, para establecerse como los únicos suministradores del original ron Havana Club.
Cuba dice que solo ellos pueden vender el verdadero ron cubano, que debe ser fabricado en Cuba(aunque, por el embargo, no se puede exportar a Estados Unidos) y la familia dice que sólo ellos tienen la receta original de Havana Club y la expropiación cubana no le concede derechos a ese país y, aunque lo fabriquen en Puerto Rico, sigue siendo ron cubano original.
Teniendo en cuenta cómo se ha desarrollado todo esto hasta ahora, las expropiaciones, la política, y la falta de denominación de origen de ron, ¿quién realmente tiene razón y quién realmente es el propietario de Havana Club?
El tiempo nos dará la respuesta de quienes son los verdaderos dueños.
