SPAIN: WILL OBTAIN SPANISH CITIZENSHIP AN ESTIMATED OF 200,000 CUBANS WITH THE NEW “LAW OF NIETOS”
More than 200,000 Cubans could acquire Spanish nationality with the reform to the Law of Historical Memory that was approved this Monday by the Senate of Spain, in order to “repair unfair situations” and legal gaps within it.
This was announced by the Martí Noticias portal in a report that quoted representatives of specialized law firms. “Many Cubans who could not qualify for Spanish nationality in 2010, because the Historical Memory Law ended their term, will be able to do so,” said Cuban lawyer Estela Marina.
“And then, the children of Cubans who were nationalized with this law, may also opt,” added the lawyer, also president of the Aristeo Group, a corporation based in Spain that offers legal assistance services, immigration, immigration and business logistics.
The bill was introduced by the leftist United Podemos bloc and was “taken into consideration” by 254 votes in favor, none against and only one abstention. In the plenary session of the Senate, the four cases that will be modified in the legislation were mentioned:
Women who lost their nationality by marrying foreigners
Children of nationals of origin by virtue of the Law of Historical Memory, who, because they were of legal age, could not obtain it
Grandchildren of Spaniards who emigrated and lost their nationality
Grandchildren of Spaniards who lost their nationality because they did not ratify it
Legal sources consulted by Martí Noticias estimated that the law could be in force within a year.
The website reports that currently 140,000 people with Spanish nationality reside in Cuba, most of them obtained the status with the Law of Historical Memory, promulgated by the government of José Luis Rodríguez Zapatero in 2007.

Más de 200.000 cubanos podrían adquirir la nacionalidad española con la reforma a la Ley de Memoria Histórica que fue aprobada este lunes por el Senado de España, en orden de “reparar situaciones injustas” y vacíos legales dentro de la misma.
Así lo dio a conocer el portal Martí Noticias en un reporte que citó a representantes de bufetes especializados. “Muchísimos cubanos que en 2010 no pudieron optar a la nacionalidad española, porque la Ley de Memoria Histórica terminó su plazo, van a poder hacerlo”, dijo la abogada cubana Estela Marina.
“Y luego, los hijos de los cubanos que se nacionalizaron con dicha ley, también podrán optar”, agregó la letrada, también presidenta del Grupo Aristeo, una corporación radicada en España que ofrece servicios de asistencia jurídica, extranjería, inmigración y logística empresarial.
El proyecto de ley fue presentado por el bloque izquierdista Unidos Podemos y fue “tomado en consideración” por 254 votos a favor, ninguno en contra y solo una abstención. En el pleno del Senado se mencionaron los cuatro casos que serán modificados en la legislación:
Mujeres que perdieron la nacionalidad al casarse con extranjeros
Hijos de nacionales de origen por virtud de la Ley de Memoria Histórica, que por tener mayoría de edad no pudieron obtenerla
Nietos de españoles que emigraron y perdieron la nacionalidad
Nietos de españoles que perdieron la nacionalidad por no ratificarla
Fuentes jurídicas consultadas por Martí Noticias estimaron que ley podría estar en vigor dentro de un año.
El portal reseña que actualmente residen en Cuba unas 140.000 personas con nacionalidad española, la mayor parte obtuvo el estatus con la Ley de Memoria Histórica, promulgada por el gobierno de José Luis Rodríguez Zapatero en 2007.
