La firma de abogados de Miami Rivero Mestre LLP anunció este miércoles que, al amparo del título III de la ley Helms-Burton, presentó una demanda colectiva contra la plataforma de búsqueda de plazas hoteleras Trivago por hacer negocios con propiedades confiscadas por el Gobierno de Cuba.

Además de la presentación de la demanda, se notificó a Expedia, a la que pertenece Trivago, y a Booking y sus respectivas filiales y asociadas la intención de demandarlas en caso de que en 30 días no hayan puesto fin a sus operaciones comerciales con propiedades confiscadas en Cuba y compensado a sus antiguos dueños o herederos.

Los iniciadores de la demanda son Andrés Rivero, Jorge A. Mestre, Carlos Rodríguez, Ana Malave de Rivero Mestre y Manuel Vázquez, informó EFE.

Al tener carácter colectivo, a la demanda se pueden sumar ciudadanos estadounidenses cuyas propiedades hoteleras en Cuba fueron expropiadas y luego explotadas por servicios de reservas de hotel como Trivago, señaló un comunicado de la firma legal.

En sus páginas digitales, esas compañías promueven activamente y publicitan reservas en propiedades hoteleras “traficadas ilegalmente”, agregó la demanda.

Precisamente Andrés Rivero, uno de los abogados de Rivero Mestre, notificó el 20 de mayo pasado al grupo hotelero español Meliá la intención de los herederos de Antonio Mata de demandarlo en los tribunales de Estados Unidos por operar un hotel en Cienfuegos que les fue confiscado hace casi 60 años.

La familia de Antonio Mata Álvarez, de origen asturiano y propietario del hotel San Carlos de Cienfuegos, demandó a funcionarios cubanos que lucraron con el contrato por el que Meliá opera el establecimiento y además notificó a la compañía española.

El abogado Nicolás Gutiérrez, presidente de la Asociación Nacional de Hacendados de Cuba en Miami, que ha presentado ya varias demandas amparadas en el título III, dijo este miércoles que por la misma propiedad de los Sánchez Gil, un enorme terreno con 57 kilómetros de costa, se va a notificar en Estados Unidos a otras hoteleras españolas.

Gutiérrez vaticinó que en las próximas semanas se verán por al menos varias decenas de estas demandas, ya que las familias afectadas actualmente están preparándose con sus abogados para presentarlas.

“Todo esto, hecho bien, constituye un proceso complejo y toma su tiempo debido…, les garantizo que una gran cantidad de estas demandas está en camino y llegará bastante pronto, afectando todos los principales sectores económicos donde la dictadura castrista cuenta con la inversión extranjera”, agregó.

La agencia de viajes en línea Expedia, de la que Trivago es filial, acordó recientemente pagar una multa de 325.406 dólares al Gobierno de Estados Unidos por una “aparente” violación de las sanciones económicas contra Cuba, según el Departamento del Tesoro.
